California Family Law Explained: Your Legal Guide

Understanding the intricacies of family law is essential for making informed decisions. Here are the key topics we address daily:

Divorce in California: Legal Definition and Process

Divorce, also known as the dissolution of marriage, is the legal termination of a marital relationship. In California, divorce involves:

  • Filing a Petition for Dissolution of Marriage under Family Code S2310
  • Serving the petition to the other party
  • Resolving issues like property division, custody, child support, and spousal support

Child Custody Laws: Prioritizing the Best Interests of the Child

California courts prioritize the child’s health, safety, and welfare. Factors considered include:

  • Age and needs of the child
  • Each parent’s ability to provide care
  • History of domestic violence or substance abuse

Spousal Support: Understanding Your Rights

Spousal support (alimony) ensures financial fairness post-divorce. Courts consider:

  • Length of the marriage
  • Standard of living during the marriage
  • Each party’s earning capacity
  • Contributions to the household

Domestic Violence: Legal Protections Available

Victims of domestic violence can seek restraining orders under California Family Code S6320. Our firm helps clients obtain:

  • Emergency Protective Orders (EPOs)
  • Temporary Restraining Orders (TROs)
  • Permanent Restraining Orders (PROs)

We guide clients through the process, including filing the request, presenting evidence, and attending court hearings.
