Alternatives To The Public Courtroom

Not always can a dispute be settled without some court intervention or other assistance from a third party. In some instances parties opt for mediation and appoint a third party to act in that role to help them through a settlement process. But for some, despite their efforts, they are unable to close the gap. Their option is to go to court, queue up and try to be heard by a judge who has an enormous case load and little time or staff to deal with the press of business. Another option is to hire a private or “rent a judge” The judge and the parties and the court all sign documents appointing the third party as a private judge. The judge is paid by the parties but because of the efficiency of that judge, money is saved over a court process that can drag for months to years.

One private judge relayed to me his experience is that each side saves $2 or more for each dollar they spend on a private judge. That’s because there’s no waiting around for hours and hours, travel time is either zero or less than if you have to go to the courthouse (private trials are usually held in an attorney’s conference room), there are no interruptions for other cases or ex partes or folks who come in with a stipulation, which judges reward by giving them priority over whatever contested matter is being heard. If the attorneys can estimate correctly how much time a trial or big Order to Show Cause will take, the hearing or trial can be scheduled so that the matter can be heard to completion without having to break it up into bits and pieces; thus saving the client money because the lawyer doesn’t have to keep re-preparing. Some private judges will even conduct a lot of hearings, both noticed and ex partes, telephonically, which saves even more time and money. You and the other side also choose who the judge will be.

While the single most valuable benefit to litigants is that it actually saves the parties money there are other benefits. Consider that a lot of the bumps along the way can be resolved quickly and cheaply through telephone conference calls. Consider the lawyers are in the middle of a deposition with a discovery dispute. That could result in the deposition being adjourned and the matter being briefed and presented to the court or call the private judge, tell him what it is, and get an answer.

With a private judge, you get orders that are legally identical in their effect to orders obtained from a judge in the courthouse. They are enforced exactly the same way. The parties have the same rights of appeal whether the order or judgment is issued by a private judge or by one sitting in the courthouse.

• President Barack Obama has recently come out saying that he is in favor of same-sex marriage. Though this is a pleasant surprise for some and a shock for others, we will have to see if this sets the gears in motion for same-sex marriages to becoming legal nation wide. • We’ve all said stupid or outrageous things one time or another, and going through a bad breakup or divorce usually makes us even more prone to having a regrettable outburst. But at least most of us don’t have our shameful moments ingrained in internet history thanks to the press. These celebrities aren’t as lucky.  Read More

• A recent study shows that the strides for gender equality in America are not only putting more women in high paying professional positions, but are rippling out into the courtrooms, where more women are paying spousal support than ever before.  Read More

• Here is an attorney that we are glad to not have in our firm (or have any association with at all). She is facing disciplinary action for not following through with a divorce that she was hired for, and for various violations of procedure as well as not cooperating with investigators. The action being taken against her doesn’t even take into account her behavior a few months earlier where she assaulted a police officer for trying to report a car accident she was in.  Read More

•  An Indian couple was legally divorced after the husband appeared in court via video conference. The couple has been married for over 4 years, but only lived together for the first 6 days of their marriage. Then the husband moved to the United States for work, and stayed there, making the video conference the more convenient method of making a court appearance.  Read More

• Courts have seen an escalating number of divorces in the past decade where the splitting couple wants the court to decide who gets custody of their pets. This has raised a bit of a problem since current law only sees pets as property, and not entities that can be shared or have visitation hours set up for them. But if this trend continues maybe we’ll be seeing new legislation for K9 custody.  Read More

Gary’s ex-wife is taking on one of Gary’s ex-girlfriends who was named a beneficiary of his estate in 2005. Evangelista claims she needs money for a full-time nanny, a driver, and armed bodyguards to protect Augustin. In addition, to the $46,000 monthly child support, Evangelista wants Pinault to provide Augustin a home equal to the $13 million California mansion he put in a trust for his daughter.  Read More

• Last week, former NFL star Deion Sanders was charged with misdemeanor simple assault after an altercation with Pilar Sanders last Monday. Pilar was arrested on a misdemeanor domestic-violence charge. Deion said Pilar and her friend “jumped” him inside his home. The couple are in the middle of nasty divorce.  Read More

• Pilar Sander’s divorce attorney is now publicly stating that Pilar’s recent divorce was a fraud, and that Deion wouldn’t stop calling the police until they showed up and took Pilar away with them. • A Mexican law firm is taking convenience to the next level by offering the first ever divorce gift cards. The law aims to remove the stigma that divorce has to be complicated and messy, and says divorce should be as easy as going to the supermarket and buying a card. However, this gift card is only the first step for a splitting couple, as they would have to use the card to register for an online divorce program (and of course pay much more money) to see the deed done.  Read More
